The Ministry of Health has invited members of the public to submit views on draft regulations that seek to ban shisha and other waterpipe tobacco products in Kenya.Health Cabinet Secretary Aden Duale said the proposed regulations are intended to prohibit the importation, manufacture, sale, promotion, distribution and use of shisha and related waterpipe tobacco products as part of efforts to protect public health and reduce tobacco consumption, particularly among young people.

The move forms part of the government's broader tobacco control strategy, which aims to strengthen enforcement of existing laws and curb the growing use of tobacco and nicotine products in the country.

Public Participation Process

According to the Ministry of Health, the draft regulations have been published to allow stakeholders, industry players, health experts and members of the public to provide feedback before the rules are finalized. The ministry has encouraged citizens to review the proposals and submit their views within the stipulated public participation period, in line with constitutional requirements on public involvement in policymaking.

Government's Push Against Tobacco Use
The proposed regulations come amid increased government efforts to combat tobacco-related health risks. In recent months, the Ministry of Health has intensified enforcement measures against tobacco and nicotine products, including the destruction of seized consignments of shisha, flavoured e-cigarettes and other illicit tobacco products.

The government maintains that tobacco use remains a major public health concern, contributing to diseases such as cancer, cardiovascular illnesses and respiratory conditions. Officials have also expressed concern over the popularity of shisha and other flavoured tobacco products among young people.

Strengthening Tobacco Control Laws
The proposed ban aligns with ongoing efforts by the Ministry of Health to strengthen tobacco control legislation and regulations. CS Duale has previously called for stricter controls on products such as shisha, arguing that existing legal frameworks require enhancement to effectively address emerging tobacco and nicotine products.
If adopted, the regulations would significantly tighten restrictions on waterpipe tobacco products in Kenya and reinforce the country's commitments under international tobacco control agreements.

Next Steps
The Ministry of Health will review submissions received during the public participation exercise before determining whether to proceed with the implementation of the regulations.
Stakeholders are expected to present their views on the potential health, social and economic implications of the proposed ban as the government seeks to strengthen measures aimed at reducing tobacco use and protecting public health.
